How does a person get
sentenced to death row
for a crime they did not
commit?
Ultimately, it’s often a
“perfect storm” of factors
that leads to tunnel
vision, said Jon Gould,
principal investigator of
the Preventing Wrongful
Convictions Project.
Gould discussed the
project’s findings during a
presentation at the
University of South
Dakota Thursday
afternoon.
“Tunnel vision is the
notion that as you start to
get a theory of what’s
going on in the case, it
becomes harder and
harder and harder to
convince yourself that the
case is not going the way
you think,” Gould said.
This was the biggest
surprise of the entire
project, he said.
The Preventing
Wrongful Convictions
Project was commissioned
by the US Department of
Justice, which wanted
wrongful convictions and
near-misses to be
investigated through
social science methods.
The research was
carried out by Gould and
three other faculty
members from across the
country and nine
graduate student research
assistance, with help from
a wide variety of law
enforcement agencies.
They then collected 80
variables’ worth of data
for 260 wrongful
convictions and 200 nearmisses, all of which were
serious felony cases.
While there are a
number of factors that
can lead to a wrongful
conviction, three go hand
in glove to “tell a story of
systematic error,” Gould
said.
The first is the
prosecution withholding
evidence from the
defense, either
intentionally or
unintentionally.
The second is the
quality of defense a
defendant receives.
“If you have a lawyer
meeting you for the first
time on the day of trial …
you can imagine that’s a
case where you’re
probably not going to
have someone doing an
investigation ahead of
time, or asking for a
continuance to get more
information,” Gould said.
While these factors
were predicted by the
panel, the third was not.
“The weaker the
prosecution’s evidence (in
cases like this), the more
likely a wrongful
conviction,” Gould said.
The panel did not
understand how this
could be until a sergeant
gave an explanation.
“He said, ‘These cases
come in, and there’s not a
lot of evidence. We don’t
have a whole lot to go on,
and people let these
things sit. There’s nothing
else to investigate, there’s
not more evidence, and
we let them sit. The
longer they sit, the more
likely it is that prosecutors
are not going to dismiss
these,’” Gould said.
While the prosecutors
often end up giving these
cases over to juries,
further investigation
would have revealed
exculpatory evidence that
would clear the
defendant, he said.
Gould refers to these
cases as “the system
doesn’t give a damn
cases.”
“They come in with
their evidence, police
prosecutors are not doing
a lot of investigation,
defense lawyers are not
doing a lot of
investigation, and as a
result, we have a perfect
storm of what’s called
tunnel vision,” he said.
While those are the
three main factors, others
are in play, as well.
People under 24 years
of age are more likely to
be wrongfully convicted,
due in part because they
are less familiar with the
criminal justice system
and less able to assist their

defense, Gould said.
They are also less likely
to be employed, and have
an alibi as to where they
were when the crime in
question took place, he
said.
Another factor is
whether the defendant
has a prior criminal
record, regardless of the
severity of those crimes.
“Having any criminal
records means that the
police are more familiar
with you,” Gould said.
“They are more likely to
think … ‘Hmm, who in
this area has any prior
connection to the
criminal justice system?
Oh, that guy.’
“Number two, if you
have a prior record,
there’s more likely to be a
mug shot of you. And if
there’s a mug shot of you,
there is a greater chance
that a witness who’s not
trying to pick you out
wrongly nevertheless
mistakenly picks you out,”
he said.
Honest eyewitness
error also can lead to
wrongful convictions.
“Honest eyewitness
error is a witness who was
there at the crime scene,
saw what happened,
thinks they can pick out
the perpetrator and
simply gets it wrong,”
Gould said.

error is more often seen
in near-misses, as a
dishonest witness can be
caught in his or her own
lie, he said.
State punitiveness
remains a factor, as well.
“There are some states
where there’s a stronger
sense in the community
of wanting justice and
wanting it now,” Gould
said. “In states where
there is that push for
more punitiveness and
faster punitiveness, then
we might be more likely
to see wrongful
convictions.”
While Gould
acknowledged that the
criminal justice system is
“much, much more
accurate” than inaccurate,
it still does make errors.
Ultimately, preventing
those errors falls on what
people care more about
seeing, he said.
“Do you care more
about the innocent not
being indicted in the first
place, or do you care
about the innocent once
they’ve been indicted not
being convicted?” he said.
“Because, really, when we
think about the measures
that address this, that’s
what we ought to be
focused on. …
“If we address these
factors, we’re able to fix a
whole lot more in the
criminal justice system,”
he said.
