PIERRE – The people who
planned the route for the
proposed Keystone XL oil
pipeline carefully avoided
crossing the four major Indian reservations in western
South Dakota.
But the route runs entirely through the territory
promised to the Great Sioux
Nation in the 1868 treaty. By
statehood in 1889, most of
that land didn’t belong to
tribal people.
That taking, accomplished
in a single generation, is
what has ailed South Dakota
now for more than 126 years
and probably will forever
undercut our abilities to live
together.
When the state Public
Utilities Commission agreed
Tuesday that TransCanada
had certified it could still
meet the conditions of its
2010 permit to build Keystone XL, chairman Chris
Nelson said he had been
mystified for some time by
the tribal opponents.
He said a letter sent
by Debra White Plume of
Manderson explained that
she had a different worldview
about the “black snake” being
proposed by TransCanada.
The commissioners
decided early in the process
they wouldn’t be considering
who lived on the lands prior
to statehood and the 1868
treaty and who might claim
rights to it.
But what happened during
that single generation of time,
between 1868 and 1889, had
everything to do with the
tribal opposition to Keystone
XL.
We spend so much energy,
and we harbor so much
resentment, in South Dakota
from those events seven and
eight generations ago.
There’s really no practical
way to reconcile what was
taken after 1868. We aren’t
going to erase the civilization
that’s been built.
We are what we are.
There are things we can
do to get along better. We
could require an environmental impact study when
eminent domain is used to
force a corridor through
people’s lands.
In his budget recommendations, Gov. Dennis
Daugaard is asking the Legislature for $2.2 million to pay
for trying new ways to teach
American Indian children at
three schools.
The state Board of Education on Thursday updated
the schedule for revising
school standards and added
the Oceti Sakowin essential
understandings and standards to the list.
Essentially it is Indian
education for all in the public
schools of South Dakota.
The required four public
hearings would be held in
2017-2018. The state board
would adopt the Oceti
Sakowin standards in spring
2018.
The state Board of Regents and Black Hills State
University now are managing
the GEAR UP program.
The goal of GEAR UP is
to help low-income students
and their families better
understand what is needed
to attend college or technical
school after high school.
The governor’s proposal
to expand Medicaid eligibility
in turn for the federal government paying full expenses for
American Indian health care
in South Dakota is potentially
a big change too.
The Indian Health Service
would engage in new partnerships with off-reservation
medical providers. Telehealth
technology would link doctors from private hospitals
with their counterparts at rural clinics and IHS hospitals.
These aren’t small
changes but generally they
will happen outside the
worldview of most South
Dakotans.
We are what we are. We
aren’t turning back to 1868.
But if we want, we all can be
better in 2016 and after.

Secretary of State Certifies 5th Ballot Measure
PIERRE – Secretary of State
Shantel Krebs announced
that An initiated measure
to Revise State Campaign
Finance and Lobbying Laws,
Create a Publicly Funded
Campaign Finance Program,
Create an Ethics Commission, and Appropriate Funds
was validated and certified
to be on the November 2016
general election ballot as a
ballot measure the citizens
will vote on. The sponsor
turned in 24,532 signatures to
the Secretary of State’s office.
An Initiated Measure requires
13,871 signatures from South
Dakota registered voters.
Once the signatures were
delivered to the Secretary of
State’s office, a 5% random
sampling was conducted. It
was determined that 73.8%
or 18,122 of 24,532 signatures
were in good standing. This
will be Initiated Measure
22. This is the fifth initiated
measure to be approved by
Secretary of State. A total
of 8 measures were submitted for review. This office
will continue the signature
validation process of the
remaining 3 measures in the
order they were submitted
to the Secretary of State. A
total of 275,000 signatures
were submitted among all
petitions. Those looking to
challenge the Secretary of
State’s certification of a ballot
measure have 30 days from
the date they are certified,
which would be February
5, 2016. Challenges to all
statewide initiatives and
referendums must be brought
within 30 days after the petition has been validated and
filed by the Secretary of State
(SDCL 12-1-13) 1. When does
the 30 days start to run? The
30 days starts to run once the
petition is officially filed with
the Secretary of State’s Office; the petition is only filed
after the Office goes through
the petition validation process and determines that the

side which would calculate
to a copy fee of $2.00 per

process the petitions in? The
Secretary of State's office will
process each petition one at
a time, and in the order in
which they are received. 6.
The petitions are not public
documents until after the
Secretary of State's Office
has completed the validation
process and either filed or
rejected the petition. No copies can be purchased until
this process is completed
for the particular petition
of which copies are being
requested.

Gov. Daugaard Awards Four
Community Development
Block Grants
PIERRE – Last week, four community leaders were notified
that each of their respective communities has been approved
for grant funding through the Community Development Block
Grant (CDBG) program. Gov. Dennis Daugaard awarded a total of $977,500 to the communities of Faulkton, Hecla, Viborg
and Yankton for various community improvements.
“Small cities and rural areas in South Dakota are prime
candidates for the CDBG program. We’re incredibly fortunate
to have so many forward-thinking community leaders who
share the state’s values when it comes to improving our
citizens’ quality of life, infrastructure and workforce development,” said Gov. Daugaard.
The CDBG awards include the following:
Faulkton received a $515,000 grant to assist with improvements to the wastewater system in the community.
Hecla received a $157,500 grant to assist with improvements to the water system in the community.
Viborg received a $147,500 grant to assist with a library
expansion construction project.
Yankton received a $157,500 grant to assist RTEC (Regional Technical Education Center) with CNC (Computer
Numerical Controlled) machine workforce training.
The CDBG program provides local governments with
funding to complete projects that improve living conditions
and increase educational resources for low-to-moderate
income individuals. The CDBG program is funded through
the U.S. Department of Housing and Urban Development and
administered by the Governor’s Office of Economic Development (GOED).
