school. His mom and dad found a home
they think we’ll like, and they want to
gift us money for a down payment. I’m
not sure how I feel about this under our
present circumstances. Do you think we
should go ahead and accept when I’ll still
be in school and we’ll still have debt to
pay off?

Dear Emily,
You need to get to know each other
before you buy a house together. I always
recommend that young couples rent for
a year and concentrate on each other,
the new marriage, cleaning up any debts
you have, and establishing an emergency
fund. Then, after another year or so when
you’ve had time to take control of your
finances, the idea of looking for a homebecomes much smarter.
It sounds like your future in-laws are
really generous people. They’re trying to
do something nice for you two, but they
kind of got out ahead of things with this
idea. And in the process, they violated
some boundaries in your relationship

Local Response To Obama’s New Gun
Legislation

As news that President
Obama has issued an executive order in an effort to tighten gun control circulated the
country, feelings locally are
mixed. Some fully support it
and would even prefer more
restrictions, while others are
concerned.
“As the second amendment states, ‘...necessary to
the security of a free State,
the right of the people to
keep and bear Arms, shall not
be infringed’,” an anonymous
Vermillion contributor stated.
“The second amendment is
what keeps ALL Americans
free. I believe the president
is overstepping his office by
going around congress to
pass new laws, rather than
enforcing current laws. Just
think about it, when new gun
laws are passed, who does
government officials target
with those laws? The gangs
and thugs on the streets, or
the people they know that
will not fight back?”
According to the National
Conference of State Legislatures (NCSL) website, the
new proposals focus on “new
background check requirements that will enhance the
effectiveness of the National
Instant Criminal Background
Check System (NICS), and
greater education and enforcement efforts of existing
laws at the state level.”
Garrett Bankston of Vermillion sees potential in the
executive order though with
reservations.
“My feelings about background checks is that they
are a great concept and tool
to prevent criminals from
buying guns,” he said. “The
problem is the execution and
enforcement that bothers
me.”
Though Bankston stated
he hadn’t read the executive
action in its original form
as of yet, he has read the
outlines.
“The first issue that I have
is the new rule that states
if you're in the business of
selling firearms, you must
be licensed and perform a
background check,” he said.
“My concern is what classifies as being in the business
of selling guns. What if I sell
a couple guns to friends who
live in South Dakota because
I no longer want them? Am
I classified as ‘being in the
business?’”
Another one of Bankston’s
concerns is the organization
of it all.
“Without a gun registry,
how is a law enforcement
officer able to determine
whether a firearm has been
purchased before or after
this action?” he said. “How
are they supposed to determine who the firearm belongs
to?”
Another problem according to Bankston is the fact
that current laws don’t seem
to be getting enough attention to merit the creation of
more laws.
“I am willing to take any
background check because I
have a clean background,” he
said. “The issue that I have is
that criminals who attempt
to buy guns aren't being
prosecuted.”
There seems to be no end
to the questions that pop
up regarding gun control in
general.
“The majority of gun
death occur from suicide,”
Bankston pointed out. “Is
depression going to be classified as a mental illness?
Would being diagnosed with
depression interfere with
your second amendment
right to own or purchase
a firearm? If so, will that
prevent individuals from pursuing help in order to protect
their right?”

and shoots unarmed people,”
he said. “That's what frustrates me.”

Senate: Should Bail
Bondspersons Face
Federal Background
Checks?

PIERRE – People wanting state licenses to be bail
bondspersons in South
Dakota might have to first
submit to a federal criminal background, under a
proposed change pending in
the state Senate. Fingerprint
cards would be submitted to the state Division
of Criminal Investigation
and the Federal Bureau of
Investigation. Currently only
state background checks
are conducted. Senate Bill
38 was scheduled for Senate
debate Friday afternoon but
was deferred to Tuesday. The
legislation also would prohibit bail bondspersons from
using their own bonds to get
themselves out of custody.
And they would be required
to notify the state Division
of Insurance when they face
felony prosecutions. Division
director Larry Dieter testified
for the changes during the
bill’s hearing Thursday by
the Senate Commerce and
Energy Committee. “We’re
trying to protect the public
and the industry and to keep
bad actors out of the state,”
Dieter said. An incident in
Sioux Falls last year led to
a review of the state laws
involving bail bondspersons,
he said. The committee voted
7-0 to endorse the bill’s passage. “I think we’re good to
go,” Sen. Brock Greenfield,
R-Clark, said before the committee vote. “I don’t see any
bogeymen in this.”
