Four Guardrails: Noem Proposes A Path
Forward For Decriminalizing Industrial Hemp
PIERRE, S.D. – Governor
Kristi Noem today sent
the legislature her “Four
Guardrails” for a path
forward on decriminalizing
industrial hemp. She also
released the following
statement:
“Over the last
year, we’ve had a long
conversation about
legalizing hemp, and
everyone knows that I
don’t think it’s a good idea.
“Last year, I vetoed a
bill that didn’t address
concerns surrounding
public safety, law
enforcement, or funding.
I asked the legislature
to wait until we had
direction from the federal
government and a plan to
address those concerns.
Now since that time, things
have changed. Federal
guidelines have been put
in place, a South Dakota
tribe has been given the
green light on production,
and other states’ actions
mean we need to address
hemp transportation
through our state. The
legislative summer study
also did great work, and
they included some good
ideas.
“Today, I am outlining
for the legislature a path
forward – four guardrails,
if you will – on hemp.
These include: 1) reliable
enforcement standards;
2) responsible regulations
regarding licensing,
reporting, and inspections;
3) an appropriate plan for
safe transportation; and 4)
an adequate funding plan.
“Given all that we need
to accomplish this session,
if we can get this done in
the coming weeks, it would
be a good way to kick
off this year’s legislative
session.”
1. Reliable Enforcement
a. Growth or possession
of hemp is a consent to an
inspection and a search.
b. Agency authorization
to inspect fields and loads,
confiscate or seize, and
destroy or dispose of
unlawful hemp – without
liability – and the actual
costs of disposal must
be paid by the grower or
possessor.
c. Sale or use of hemp/
hemp derivatives for
smoking is prohibited.
d. Annual statistical
report by the Attorney
General to the Governor
and Legislature as to how
this act affects criminal
drug prosecutions.
2. Responsible
Regulation
a. Reasonable
regulations regarding
licensing, reporting, and
inspections that are at
least compliant with USDA
standards.
b. Minimum land area
size: contiguous outdoor
5 acres.
c. Appropriate fee
structure: application,
annual license, and
inspection.
3. Safe Transportation
a. A permit is required
for all transportation of
hemp.
b. Appropriate legal
consequences for hemp
transported without
documentation.
4. Adequate Funding

Search Underway For
Special School Administrators
PIERRE, S.D. – The search has
begun for new administrators to
oversee the two special schools in
South Dakota serving students who
are blind and visually impaired and
deaf or hard of hearing.
The South Dakota Board of
Regents manages both the South
Dakota School for the Blind and
Visually Impaired in Aberdeen and
the South Dakota School for the
Deaf in Sioux Falls. Last month, the
long-time superintendent of both
schools, Marje Kaiser, announced
her upcoming retirement in May.
Paul B. Beran, the regents’
executive director and CEO, said the
regents will seek to hire separate
administrators for the schools,
rather than a single superintendent
serving both institutions. “This will
allow for a dedicated leader at each
institution, who can focus solely
on the needs of students and their
families who are served by each
school,” Beran said. “We believe we
can reorganize some positions and
responsibilities to still be fiscally
efficient under this scenario.”
The two schools will continue to
share administrative positions in
such areas as the business office and
human resources functions.
“Dr. Kaiser offered a unique skill
set and the willingness to manage
both institutions. This arrangement
has worked very well under her
shared leadership at both schools
since 2010,” Beran said. “For
recruitment purposes, however,

Small Grant Proposals
Being Accepted
PIERRE, S.D. - The South Dakota Department of
Game, Fish and Parks (GFP) Wildlife Diversity Program
is accepting proposals for the Wildlife Diversity Small
Grants Program. This program provides funding for
researchers, educators and naturalists to carry out
projects focused on native wildlife. Funding for the 2020
Small Grants Program totals $20,000 for projects focused
on education and outreach for native wildlife species and
their habitats.
Grants from this program have funded education,
research, and monitoring projects focused on native
wildlife and habitats since 1997. A wide range of
projects have been completed to date, ranging from
spider surveys of the Fort Pierre National Grasslands to
assessing the risk of plague in black-footed ferrets.
“GFP recognizes that there is a tremendous pool of
talent and expertise outside the agency that can be very
beneficial to the mission of our Wildlife Division,” said
Casey Heimerl, a wildlife biologist with the department.
“By making small grants available, we are able to utilize
this talent and expertise. The diverse projects that have
been completed in the last 23 years have resulted in
numerous publications in scientific journals, popular
educational products, and a tremendous amount of new
information on native wildlife species and their habitats.”

Regents’ officials said the
search for the two special school
administrators should conclude
by sometime in March. The search
processes at both schools will
include input from advisory search
committee members that represent
constituencies to include employees
and parents, as well as the
foundations and advisory councils
for the special schools.
Regent Jim Thares of Aberdeen
and Regent Jim Morgan of Brookings
will co-chair the search processes at
the special schools.

For FEMA Assistance
SIOUX FALLS, S.D. – Homeowners and renters in
Aurora County may now register with FEMA for federal
disaster assistance for uninsured and underinsured
damage and loss resulting from the severe storms,
tornadoes and flooding that occurred Sept. 9 – 26, 2019.
FEMA’s Individual Assistance program includes a
range of aid such as emergency home repair, temporary
disaster housing, replacement grants for serious disasterrelated needs, and expenses not covered by insurance or
other assistance programs. If you have already repaired
or replaced damaged items, you may be eligible for
reimbursement. People are encouraged to register so
that FEMA can determine eligibility.

•By calling the disaster assistance helpline at 800-6213362 or TTY: 800-462-7585. Lines are open daily from 7
a.m.-11 p.m. Help is available in most languages.
•At one of FEMA’s disaster recovery center locations.

been added to FEMA’s government-to-government Public
Assistance program.
Public Assistance (PA) is a grant program to assist
state and local governments and certain private
nonprofit entities. Facilities are eligible for this program
if they were damaged during Sept. 9 – 26, 2019 severe
storms, tornadoes and flooding, serve a public function
and have damage that was not covered by insurance. The
PA Program provides:
•Assistance for debris removal
•Implementation of emergency protective measures
•Permanent restoration of infrastructure
•Encourages protection from future damage by
providing assistance for hazard measures during the
recovery process
Homeowners, renters, businesses of all sizes and
private nonprofit organizations are also able to apply
for low-interest loans from the U.S. Small Business
Administration.

Disaster Recovery Center while open in South Dakota.
